Public Offer Agreement.

The text of the Agreement is a proposal (public offer) to use the online service: https://protoeducademy.com/ (hereinafter - the Site), access to which provides an opportunity to receive services and use information resources of the Administrator of the site of ИП (Legal Entity or IE) (hereinafter - the Administrator).
Payment for services provided on the Administrator's site by an individual / legal entity (hereinafter - the User) is an acceptance of this public offer, which is equivalent to the conclusion of the contract (hereinafter - the Contract) on the terms set out in it.
If the User does not agree with the text of the Contract, the Administrator offers to refuse to use the services provided.
1. Main terms and conditions1.2 The User and the Administrator have concluded the present contract (hereinafter - the Contract) for receiving services provided by the Administrator, in accordance with the current legislation of the Republic of Kazakhstan.
2.2 Terms used in the text of the Agreement:
‘Offer’ - a public offer to use the online service;
‘Acceptance’ - unconditional acceptance by the User of the terms and conditions of the Agreement in full;
‘Administrator’ - service-provider being the owner of the site;
‘User’ - any physical/legal person who accepts the terms of the agreement and uses the services provided on the site of the Administrator;
‘Services’ - English Language Courses;
‘Site’ - a set of software tools that ensure the publication for public viewing of information and data, united by a common purpose, through technical means. The Site is available to Users by a unique electronic address or its letter designation. The Site in the Agreement means the Administration's website located on the Internet at https://protoeducademy.com/.
2. Subject of the offer2.1 The Administrator provides English language training services on the Site.
2.2 The Administrator undertakes to provide technical maintenance and support of the Site.
2.3 The current version of the Agreement is publicly available on the Website at the address: https://protoeducademy.com/.
3. Use of the online service3.1 To receive the Administrator's service, the User chooses a tariff plan at his/her own request, registers by providing personal data and makes a payment.
3.2 Payment by the User means unconditional and full agreement with the terms of the Agreement. The day of payment for the Services by the User shall be deemed the day of conclusion of the Agreement for the term specified in the service package.
4. Registration on the website, confidentiality and protection of personal data4.1 Personal data contains the following information:
Surname, first name, patronymic of the User;
E-mail address (E-mail);
Password and login for entering the personal account;
User's status (natural/legal person);
Residential address;
IIN/BIN
4.2 If necessary, the User has the right to edit the entered data about him/herself in the personal cabinet.
4.3 The Administrator undertakes not to disclose the information received from the User. It is not considered a breach of obligations to disclose information in accordance with reasonable requirements under the current legislation of the Republic of Kazakhstan.
4.4 The User is responsible for all actions and consequences of using the personal account, for voluntary transfer of access to his personal account to third parties, as well as for unauthorised access. All the above actions will be considered to be performed by the User himself.
5. Rights and obligations of the parties5.1 Administrator:
Undertakes to provide technical support and complete information within the framework of the bundled Services.
Is obliged not to disclose personal data of the User;
Is not liable in connection with the information provided by the User.
Has the right to unilaterally change the terms and conditions of the Services and make changes to the wording of the Agreement.
5.2 The User:
Is fully responsible for the correctness of the information entered during registration on the Administrator's Website, as well as for late submission of changes to the registration data;
Is personally liable for any actions performed using his/her personal account, as well as for any consequences that could or have entailed such use by third parties in case of improper storage of login and password by the User.
Has the right to use the Website services in his/her own interests without directly interfering with its operation.
6. Payment procedure:6.1 Payment shall be made to the Administrator's account by bank cards or other non-cash methods after registration under the following tariff plans (packages of Services):
6.2 Services are provided on condition of 100% prepayment, test periods are not provided.
6.3 The Administrator independently controls the expiry date of the Services.
6.4 The User is responsible for the correctness of payments.
7. Responsibility of the parties, dispute resolution7.1 The Parties shall be liable for failure to fulfil or improper fulfilment of their obligations in accordance with the current legislation of the Republic of Kazakhstan.
7.2 All disputes arising between the Parties in the execution of this Offer shall be resolved through peaceful negotiations, and in case of failure to reach an agreement between the Parties, the dispute shall be considered in court in accordance with the current legislation of the Republic of Kazakhstan in the arbitration court at the place of registration of the Administrator.
8. Term of the contract and its cancellation8.1 The public offer comes into force from the moment of acceptance of the Offer and is valid during the period of providing access to the Administrator's Site.
8.2 The Administrator has the right to block access to the server in the following cases:
Upon receipt of orders of state bodies of the Republic of Kazakhstan;
In case of violation of copyright and related rights;
In case of motivated appeal of third parties in case of violation of their rights;
In case of detection of information posted by the User that is prohibited by the legislation.
8.3 The Customer has the right to refund the paid money in full, 15 (fifteen) days in advance and in the amount of 50% (fifty per cent) 7 (seven) days before the beginning of the services rendering by the Executor. Once the Customer has received online access to the multimedia courses, no refund will be made.
8.4 The Contractor reserves the right to unilaterally change the terms and conditions of the Contract on the terms of refund.
8.5 The refund shall be made within 30 (thirty) working days after receipt of a written application.
9. Other terms and conditions9.1 The Administrator has the right to unilaterally change the terms of the Agreement as a whole or in its part without agreement with the User. The current version is published in the general access on the Website.
9.2 This version of this Agreement is the current version and cancels the previous version.
9.3 The Parties are released from responsibility for non-performance or improper performance of the terms of this Agreement for the period of force majeure. These include such events as: natural disasters, military actions, mass riots, as well as the adoption of legislative acts by state authorities, which prevent the fulfilment of the terms and conditions of this Agreement. In this case the fulfilment of obligations by both Parties shall be postponed for the period of force majeure and its consequences.
9.4 In everything else, which is not stipulated by the terms of this Agreement, the Parties shall be guided by the current legislation of the Republic of Kazakhstan.
